WHAT DO WE NEED TO SPONSORE SIBLINGS TO THE US?

Currently, Vietnamese who want to immigrate to the US will have to submit documents, self-interview and meet the requirements of the US Immigration Department. In addition to this form of visa application, the US immigration law also allows citizens to be sponsored to immigrate to the US under the F4 sibling category.

1. What is the status of a sibling in the US?

According to the US immigration law, if you are a US citizen, you can sponsor your brother or sister from Vietnam to come to the US to settle down. This stream is classified as the 4th priority, so it is often referred to as the F4 petition.

The F4 sponsored person will receive a 10-year green card and enjoy the policies of a US resident school. When living in the US for 4 years and 9 months, the sponsored person under this category will be eligible to apply for the US citizenship test. If you pass, you will become a US citizen.

The U.S sibling category has a quota based on the fiscal year (starting from October and ending in September of the following year. The number of visas granted to the F4 category per year is specified in the table below.

2. What are the US immigration records for siblings?

To apply for a US immigrant visa under the sibling sponsorship category (F4), in order for the procedure to go smoothly, you first need to prepare the following documents:

Copy of passport, citizenship, US birth certificate;

Birth certificate of sponsor and guarantor. The birth certificate must prove that at least 2 people have a common mother or father;

A copy of the guarantor's certificate of name change (if any);

Fill out the visa application form I-130 with all required information;

In case you want to immigrate to the US under the sponsorship of an adopted sibling (not having the same bloodline) or a child of a step-parent, a child of a half-brother, you need to prepare the following documents:

A copy of the adoption decree provided that the adoption takes place before the sponsor or sibling of the adopted child turns 16 years old.

Household registration book with the name of the adopted child.

An adopted child's academic record has the parents' names on it.

If the guarantor and the guarantor have the same relationship through the form of step-parents, the immigration application documents include:

A copy of the divorce papers of the biological parent or step-parent to prove the relationship has ended.

Copy of father's divorce from his previous wife.

If the sponsor or sponsored person changes their name, you will need to submit a copy of a certificate that you have changed your name such as a marriage certificate, court name change or adoption certificate.
